Fee Policy

In addition to the standard driving rates, other fees and charges may apply. See below for details.

​

Insurance Fee

A charge will be added to all trips per 24 hours for Collision Damage Warranty (CDW) and Renter’s Contingent Liability Insurance (RCLI).  

  1. Collision Damage Warranty (CDW): This type of insurance covers damage to the vehicle when in an accident up to $35,000 with a $500 deductible, no matter who is at fault. Click here for more information on your CDW policy.

  2. Renter’s Contingent Liability Insurance (RCLI): Renter’s Contingent Liability Insurance is coverage which acts in the place of a primary automobile policy for the renter of a vehicle who does not maintain a personal automobile policy. Click here for more information on your RCLI policy.

If you have personal auto coverage for rental cars such as that which is provided by your personal auto coverage the daily insurance charge can be fully or partially waived depending on the type of personal coverage you have. Proceed to our insurance verification partner, Canopy, to begin insurance verification by clicking here. This must be completed prior to the start of your trip in order for the charges to be removed.

 

License Fee

 

Each Guest will be charged a License Fee to cover the cost of driving record processing, as reflected in the trip confirmation screen and documented in the itemized trip invoice. This fee will be charged on all first-time bookings made on any new driver's license added to the Guest's TRUQIT account, or on initial bookings made after any change to the Guest's current driver's license has been detected or reported.  This fee offsets costs for pulling driving records and reviewing and approving applications.

Under 25 Fee

 

Each Guest under the age of 25 will be charged an Under 25 Fee to cover the increased cost of insuring Guests under the age of 25. This Under 25 Fee is charged to the Guest for the reservation of a TRUQIT vehicle and is required for each trip and any extensions on the Trip. Discount codes and promotions cannot be applied to the Under 25 Fee.

 

If under the age of 25, the following Under 25 Fees apply: 

Age 19         75% of Trip price
Age 20         45% of Trip price
Age 21         25% of Trip price
Age 22         15% of Trip price
Age 23         10% of Trip price
Age 24         5% of Trip price

 

Taxes

 

Where required by applicable law, state and local taxes are charged on a per-Trip basis to the cost of the reservation for the Trip, any extensions for the Trip. The amount of tax applicable to a Trip is reflected in the confirmation for that Trip.

 

Cancellation Fee

​

When a Guest cancels a Trip, a Cancellation Fee may be charged. This fee is charged to compensate for the time the car was booked and unavailable for other potential Guests.

After a Guest has accessed and/or driven the car, or after the Trip has started(whichever occurs later), the Trip is not refundable and may not be canceled.

Cancellation within 1 hour after booking the Trip but before the Trip start time: no fee.

More than 1 hour after booking the Trip, the following cancellation fees apply:

    1. Cancellation prior to 24 hours before the Trip starts: no fee.
    2. Cancellation less than 24 hours before the trip starts: 50% of Trip price.

If daily rental insurance was purchased the first day can not be refunded after the trip start time.

​

Cleaning Fee

​

When a Guest returns a car excessively dirty, as supported by inspection documentation, a Cleaning Fee equivalent to the cost of cleaning + $25.00 will be charged at TRUQIT's sole discretion.

Mileage Fee

 

For all miles traveled over the Trip mileage allotment, Guests will be charged a Mileage Fee. Trips include 20 miles for each trip hour, up to 200 miles in a 24-hour period.

Damage Fee

 

In the event of any loss or damage to the car, or any personal property or bodily injury claim, that occurs during the Trip period due to any cause regardless of fault, including, but not limited to, collision, rollover, theft, vandalism, seizure, fire, flood, hail or other acts of nature or God, the Guest is held responsible, and is required to pay TRUQIT a Damage Fee. In the event a Guest has violated TRUQIT’s Terms of Service, the fee limit does not apply, and the Guest may be held responsible for the full amount of the claim.

Up to $3,000.00 across all cars

 

Service Fee

 

When TRUQIT intervenes in any event due to violations of our Terms of Service or other actions taken by a Guest, Service Fees may be charged at TRUQIT’s sole discretion to cover administration and other costs incurred to resolve the issue.

Key Charge

 

If a Guest loses or damages a TRUQIT car key during or after a Trip, the Guest is solely responsible for the costs of replacing the lost or damaged key: this includes key replacement, servicing, programming, and any/all other associated costs (to include an additional Key Fee).

Fuel Charge

In an effort to provide the best car sharing experience for everyone, we require Guests to replace any fuel used during the trip. In the event that gas is not properly refilled before the car is returned, the guest will be charged for the cost of gas at $9.99 per gallon which is based upon the difference in percentage of fuel at the start and end of the trip.  Refunds will not be offered when trucks are returned with more fuel than at trip start without prior written approval from TRUQIT.

Toll Charge

 

Guests are responsible for any and all tolls incurred while operating a TRUQIT vehicle. These tolls are first billed to TRUQIT who then charges the responsible Guest for each toll plus a Toll Fee.

Citation Charge

 

Guests are solely liable for parking tickets, traffic citations, and other infractions and violations that occur during and 24 hours after the end of the Trip, and all fees resulting from such violations per TRUQIT policy. It is the sole responsibility of the Guest to pay these fees in a timely manner and to comply with all legal obligations that arise from such violations.

Guests are solely liable for any and all tow and impounding fees that are incurred during and subsequent to the Trip, and all fees resulting from such violations per TRUQIT policy.

Car Retrieval Charge

 

If additional vendor assistance is required to retrieve a TRUQIT vehicle from an impound facility, the responsible Guest is liable for the additional car retrieval costs incurred by TRUQIT. An additional Retrieval Fee may also be charged at TRUQIT’s sole discretion.

Roadside Assistance Charge

 

Guests are not responsible for roadside assistance expenses incurred by TRUQIT in connection with their Trip, unless any of the following circumstances are present: 

 

  1. Damage or loss results from the Guest's 

    1. intentional, willful, wanton, or reckless conduct

    2. operation of the car under the influence of drugs or alcohol 

    3. towing or pushing anything

    4. operation of the car on an unpaved road if the damage or loss is a direct result of the road or driving conditions

  2. Damage or loss occurs while the car is 

    1. used for commercial hire 

    2. used in connection with conduct that could be properly charged as a felony

    3. involved in a speed test or contest or in driver training activity

    4. operated by a person other than the Guest who reserved the car

    5. operated outside the United States 

  3. The Guest has provided false or fraudulent information to TRUQIT, and TRUQIT would not have facilitated the Reservation period for the Guest if it had instead received true information

  4. The Guest has violated any terms of this Agreement 

  5. The Guest fails to close and lock all windows, doors and trunk, and the car is stolen, damaged, or vandalized

  6. The Guest fails to notify TRUQIT immediately after an incident or loss

  7. The Guest fails to pay any other amount due under this Agreement.

 

Cost of roadside assistance services

 

Improper Return Fine

 

If a Guest returns a car improperly resulting in inconvenience for the next driver, an Improper Return Fee may be charged. Improper Return Fees may be applied if the car is returned at the incorrect parking space, a toll tag is lost, lights are left on resulting in a dead battery, or any other instance where a Guest returns a car negligently and/or improperly.

Smoking Fine

 

Smoking in TRUQIT vehicles is strictly prohibited. If the next driver of a car reports evidence of smoking such as strong odor, ashes, etc, a Smoking Fine will be charged to the offending Guest.

Late Return Fine 

 

If a Guest returns a car late, the Guest may be charged a Late Return Fine for each hour or fraction thereof that the car has not been returned.

Late Return Extension Fine

 

If a trip extension is applied to a Trip because the car has not been returned before the Trip's originally scheduled end time and the Guest has not extended the Trip before such scheduled end time, a Late Return Extension Fine shall be applied as reflected herein, in addition to the cost of the trip extension itself.

Unauthorized Driver Fine

 

If a Guest allows an unauthorized driver to operate a TRUQIT vehicle during any Trip period, the Guest will be charged an Unauthorized Driver Fine at TRUQIT’s sole discretion. Payment of the Unauthorized Driver Fine does not imply TRUQIT membership or insurance coverage for the unauthorized driver. The Unauthorized Driver Fee is separate from any other fees, fines, charges, or other legal remedies TRUQIT may have, as further described in our Guest Policy.

Unreported Damage Fine

 

Guests are required to report any car damage incurred during their Trips within 48 hours of such damage being incurred, unless the Guest has been rendered incapable of doing so. Failure to report such damage to support@truqit.com  will result in the Guest being charged an Unreported Damage Fine of $200 for each Trip during which car damage was incurred and not reported in a timely manner.

Nondiscrimination policy

​

Who May Drive the Car.  New York State Law prohibits the following practices by rental vehicle companies based upon race, color, ethnic origin, religion, disability, sex, marital status, or age: (1) refusal to rent; (2) the imposition of any additional charge (except in certain instances where the renter is under the age of 25). In addition, it is unlawful for any rental vehicle company to refuse to rent a vehicle to any person solely on the requirement of ownership of a credit card.

Take and upload photos to document the vehicle’s condition and cleanliness pre- and post-trip. Photos help TRUQIT support you with settling payment disputes, confirming late return claims, assessing damage claim eligibility, and monitoring vehicle safety. Use the TRUQIT app for iOS or Android to take photos.

Take at least eight photos of the following areas of the vehicle’s interior. Be sure to clearly document fuel/EV charge level and odometer reading, as well as any interior stains, spills, or debris.

Tip: Take pre- and post-trip photos from identical views so it’s easy to compare the two. 

Guest Referral Program Policy

The Guest Referral Program allows existing Guests and new Guests to earn a bonus by referring individuals to become new Guests on TRUQIT using the existing Guest's personal referral link.  The following terms and conditions apply to all Guests (collectively, “Participants”) participating in this Program.

 

Eligibility

Participants must be at least 19 years old. All trips booked as part of the Program must comply with TRUQIT’s Terms of Service.

 

The Guest Referral Bonus

Participants may earn a Guest Referral Bonus if:

  1. The referred individual becomes approved to drive on TRUQIT and accepts the Terms of Service; and

  2. The referred individual uses the Participant’s referral code when booking their Reservation; and

  3. The referred individual doesn’t cancel their first Reservation.

 

The following restrictions apply when earning the Guest Referral Bonus:​

  1. The Participants and referred individual must at all times be separate people;

  2. The Participants and referred individual must not share an address;

  3. The Participant must have had at least one completed rental on TRUQIT within the 6 months prior to the referred individuals first trip on TRUQIT; and

  4. The Program may only be used for personal, non-commercial purposes.

Referral Codes

Each referred individual may only make use of a Referral Code once, and in case multiple Referral Codes are received, only the Participant associated with the Referral Code actually used to book a trip on TRUQIT will earn the Guest Referral Bonus associated with that trip. In the event multiple Participants claim credit for a particular trip, TRUQIT may, in its sole discretion, investigate and decide which Participant is eligible for the Guest Referral Bonus.

 

Referral Codes may not be published or distributed on commercial websites (such as coupon websites), blogs, Facebook, Instagram, Reddit or other social networks. Participants are prohibited from using mass emails, texts or other forms of direct or indirect communication with people they do not know, and are prohibited from using automated systems or bots through any channel to distribute their Referral Codes. Participants are also prohibited from paying to advertise their Referral Codes.

Payment of Guest Referral Bonuses

The Guest Referral Bonus will be in the form of a TRUQIT promotional credit, generated for each referred individual who meets the above requirements.

Guest Referral Bonuses are accrued based on a Reservation's start date and time, (based on the UTC timezone), and only non-cancelled trips are accounted for. Only one referral bonus can be applied per trip.  Participants are responsible for any taxes, fees or charges that may arise from earnings and payouts of any Guest Referral Bonuses.

TRUQIT may, at its sole discretion, suspend the Program or cancel credits if abuse of the program is suspected.  

Cookies, web beacons, and similar technologies

 

TRUQIT uses “Cookies”, web beacons, and similar technologies in connection with our Platform to obtain information. A Cookie is a small data file that is transferred to your device (e.g., your phone or your computer) for record-keeping purposes. Cookies can be disabled or removed by tools that are available in most commercial browsers. The preferences for each browser or device you use will need to be set separately and different browsers and devices offer different functionality and options. Please note that some parts of our Services may not work as intended or may not work at all without Cookies.

TRUQIT Cookies and third party Cookies

 

TRUQIT, or our service providers, may place our Cookies on your device via our Platform. Accordingly, our Privacy Policy will apply to our treatment of the information we obtain via our Cookies. There are two types of Cookies — “persistent Cookies” and “session Cookies” — used in connection with our Services. Session Cookies will normally expire when you close your browser, while persistent Cookies will remain on your device after you close your browser, and can be used again the next time you access the Platform.

TRUQIT uses Cookies for a number of purposes, such as:

  • Operationally necessary. We, and third party companies and individuals we engage to provide services to us, may use Cookies, web beacons, or other similar technologies (collectively “Cookies”) that are necessary to the operation of our sites, services, applications, and tools (“Platform”). This includes technologies that allow you access to our Platform that are required to identify irregular site behavior, prevent fraudulent activity, and improve security or similar functions.

  • Performance-related. We may use Cookies to assess the performance of our websites, applications, services, and tools, including as part of our analytic practices to help us understand how our visitors use our Platform, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our Platform.

  • Functionality-related. We may use Cookies that allow us to offer you enhanced functionality when accessing or using our Platform. This may include identifying you when you sign into our sites or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our sites.

  • Advertising or targeting-related. We may use first-party or third-party Cookies to deliver content on our Platform or on third-party websites and applications. This includes using technologies to understand the usefulness to you of content that has been delivered to you, such as whether you have clicked on an advertisement.

We also use Google Analytics, which uses Cookies and other, similar technologies to collect information about use of the Services anonymously and reports website trends, without identifying individual visitors. Changes to this Cookie Policy

 

We can change this Cookie Policy at any time. If we make material changes to the Cookie Policy, we will let you know either by posting the changed Cookie Policy on the Platform or by sending you an email. It's important that you review the changed Cookie Policy. If you do not wish to agree to the changed Cookie Policy, then we cannot continue to provide our Services to you, and your only option is to stop accessing our Services.

Guest Policy

Personal Use Only

 

Trucks may only be reserved for personal use. You agree not to reserve a truck to carry passengers for hire or property for hire without the permission of TRUQIT.

​

Reasonable Use

​

You agree not to engage in competitive driving or racing; carry passengers other than in the interior or cab of the Truck; carry passengers or anything else in excess of the capacity of the Truck; use the Truck to push, propel, or tow another car, trailer, or any other thing; engage in illegal or dangerous activities; or otherwise use the Truck in a manner aside from its intended use for transportation. You agree to drive and park with reasonable care, keep the Truck clean, and return it on time.

Proper Care

​

TRUQIT is a truck sharing community. To ensure that the next guest after you enjoys their trip, we ask that you return the truck in as good (or better) condition than you found it at the start of your trip. This means committing to the following: 

  • Remove all trash, shake out floor mats and ensure no mud, dirt or pet hair remains.

  • Take the truck through the car wash if it becomes visibly muddy/dirty (car body, wheels, or windows) as a result of your trip.

  • Wipe down surfaces and ensure no odor remains.

  • No smoking or other use of tobacco and marijuana products (including, but not limited to, cigarettes, e-cigarettes or vaping devices, pipes, cigars, snuff, or chewing tobacco) in or near the truck.

​

If a truck is returned excessively dirty (failure to follow steps above) upon return, you understand and agree that you may be subject to the charges outlined in our Fee Policy and could be removed from our platform. Moreover, non-compliance with this term may impact your ability to book in the future.

​

Secure the Truck

 

You must lock and secure the Truck doors and windows as well as turn off the ignition at the end of your Reservation. You agree and understand that failure to do so may result in charges outlined in our Fee Policy, including any resulting costs arising out of your failure to secure the Truck.

​

Fuel

​

You agree to return the Truck with at least the same amount of fuel in the tank as was present at the start of your Reservation. If the fuel is not filled back to the level present at the start of your Reservation, you may be charged fees in accordance with our Fee Policy. You further agree that you are responsible for refueling the truck with the correct fuel type and you accept full liability for any damage or loss caused by refueling a Truck with the incorrect fuel type.

​

No Pets

​

You understand and agree that no pets are allowed in a Truck except in designated ”Pet Friendly” Trucks. In all cases, you agree to provide and keep your pet in a carrier cage during the Reservation and to return the Truck in a clean condition free of pet hair and pet waste.

​

No Smoking

 

You agree that you will not smoke in any Truck and you understand that you may be fined in accordance with our Fee Policy for violating this Guest Policy.

​

USA and Canada Only

 

You may not to drive a Truck outside of the United States and Canada. Trucks may not be driven to Mexico, or any other destination outside of the United States and Canada.

​

No Illegal or Illicit Activities

 

You may not carry out a crime or participate in any other illegal activity while operating a Truck.

​

Normal Operation Only

You may not use a Truck for any negligent use where the intent is abusive or abnormal for its operation.

​

Authorized Drivers Only

You agree that you have reviewed and meet our Eligibility Requirements prior to each Reservation. You understand and agree that, for all TRUQIT trucks that you reserve, you are the sole authorized driver (“Authorized Driver”) allowed to drive your reserved truck. You shall not permit any other person (an “Unauthorized Driver”) to drive the Truck that you have reserved, regardless of whether the Unauthorized Driver has a valid TRUQIT account and would otherwise be an Authorized Driver if they had reserved the Truck that you booked. Should you permit an Unauthorized Driver to drive the Truck that you have reserved, you will be fined in accordance with our Fee Policy, and your TRUQIT account will be terminated. These fines are separate from any legal remedies TRUQIT may have in connection with your violation of these Terms of Service. Further, you understand and agree that you are solely responsible for any damage, loss, claim, and liability arising from actions taken by such Unauthorized Driver to the maximum extent permitted by applicable law and these Terms of Service.

Trip Parking

 

The parking spots occupied by Trucks at their TRUQIT designated parking locations are reserved solely for the Trucks assigned to those locations. Trucks not assigned to the location by TRUQIT may never occupy any parking spot reserved by TRUQIT, regardless of how long the occupancy lasts or the duration of any Trip. The foregoing restriction includes (without limitation) the parking of personal cars in spots reserved for or by TRUQIT. Non-TRUQIT Cars occupying such parking spots will be removed at their owners’ expense, which may include towing, storage, and citation fees related to such removal.

Document All Damage

 

Before driving the Truck, you shall submit an inspection report including photos of any pre-existing damage through the Service. You understand and agree that you may be liable for any damage that you fail to report before driving the Car, at the discretion of TRUQIT.

​

Traffic Tickets and Moving Violations

 

You understand and agree that you are solely liable for traffic tickets, moving violations, and any other traffic violations that occur during your Reservation, including all resulting fees. You understand and agree that TRUQIT or its agents may choose to challenge, settle, or assign to you violations that occur during your Reservation; and you authorize TRUQIT or its agents to release information relating to your account to any government agency or court necessary to settle such claims.

Parking Tickets and Street Parking

 

You understand and agree that you are solely liable for parking tickets and citations that are incurred during your Reservation, including all resulting costs such as towing, impound, retrieval, and administrative charges. You agree to pay these fees in a timely manner and to comply with all legal obligations that arise from such violations. If you street park a Truck at the end of your Reservation, you understand and agree that you will park such Truck on the street legally and in compliance with all public ordinances and private bylaws, including curbing of the Truck wheels as required, in a spot that is legal, unrestricted, and not subject to ticketing, towing, impound, or citation for at least 24 hours (the “24-hour Period”) to allow for TRUQIT to take back possession of the such Truck. You further understand and agree that for the 24-hour Period, you are solely liable for all tickets and citations, including all resulting costs such as towing, impound, retrieval, and administrative charges. You understand and agree that TRUQIT or its agents may choose to challenge, settle, or assign to you tickets and citations that occur during your Reservation or the associated 24-hour Period; and you authorize TRUQIT and its agents to release information relating to your account to any government agency or court as necessary to settle such claims.

​

Tolls

 

You are solely responsible for paying all tolls in a timely manner and for complying with all legal obligations. For a Truck registered with TRUQIT’s Toll Account, when you pass through a toll plaza or an electronically tolled lane, the toll will be paid by TRUQIT. You understand and agree that your primary credit card on file with our Service will be automatically charged for the price of the toll at the rate specified for video tolling (e.g. Pay-By-Plate) along with any toll fees specified in our Fee Policy.

Roadside Assistance

 

We may provide roadside assistance for accidents and breakdowns that occur during a Reservation. If roadside assistance is not available during a Reservation for any reason, or, if your own negligence contributes to the breakdown or need for roadside assistance, you understand and agree that you are solely responsible for all roadside assistance costs, including all resulting costs such as towing, impound, retrieval, and administrative charges, and that you may be additionally charged in accordance with our Fee Policy. If you reject the roadside assistance provided by TRUQIT and instead utilize a road assistance provider of your choice, you shall indemnify TRUQIT from any and all claims arising out of your rejection of TRUQIT’s roadside assistance.

​

In the case of a mechanical breakdown caused by the TRUQIT's failure to perform regular maintenance and inspections, TRUQIT will attempt to transfer the Guest’s reservation to a nearby available Truck. If there are no available Trucks nearby, TRUQIT’s responsibility in such a situation is limited to the portion of the trip price paid by the Guest that is attributable to the unused part of the reservation. If there are no available Trucks nearby, TRUQIT may, in its sole discretion, reimburse the Guest for reasonable expenses incurred directly by the Guest and required to transport the Guest and any affected passenger(s) to a safe location within 25 miles of the site of the breakdown.

​

Stickers and Car Modification

 

You may not place stickers, signs, symbols, or other devices, modifications, advertisements, or publicity materials on the interior or exterior of a Truck without the explicit permission of TRUQIT.

​

Hitchhikers

 

You may not pick up hitchhikers or persons unknown to you while in a Truck, whether before, during, or after a Reservation.

​

Drugs and Alcohol

 

Guests may not operate the Truck while under the influence of alcohol, or any prescription or non-prescription drug for which driving during use is not recommended on the label or by reasonable opinion of a pharmacist or doctor.

Weapons

 

Guests may not possess, or use Trucks to transport, any items or objects that, by their nature, can be used as weapons, including (without limitation) guns or other firearms, knives, athletic equipment (unless being transported for the purpose of engaging in athletic activity), mace or pepper spray, tasers, and tools (unless being used for their intended purpose). The foregoing restrictions apply regardless of any license(s) held by or issued to a Guest that would otherwise permit such Guest to possess, carry, and/or transport the item(s) in question. Violation of this rule will result in immediate and permanent account deactivation.

Hands-Free

 

You may not operate devices that require one or both hands while driving, including but not limited to cell phones, mobile computers, or devices that allow texting. We discourage you from engaging in any activity that takes your attention off the road while driving.

​

Seat Belts

 

You must obey all applicable seatbelt laws while in a Truck. We recommend that every person in the Truck wear a seatbelt at all times.

​

Headphones

 

You may not drive while wearing any device that limits your ability to hear, see, and otherwise judge driving conditions. You must follow all applicable laws governing headphone use in a Truck, which may differ state by state.

​

Maintenance and Repairs

 

Guests are not responsible for routine maintenance and repairs of a Truck. Guests may be held liable for the repair cost for all other repairs of damage to the car during the Reservation and must follow the reporting, claims processing, and repair procedure set forth below for all such damage.

​

Driving Record

If you incur any traffic incident or driving violation that affects your eligibility as an Authorized Driver on the Service as described in Eligibility Requirements, you agree and understand that you immediately become ineligible and are no longer considered an Authorized Driver. You agree and understand that immediately you must indemnify TRUQIT for any and all losses that might occur as a result of your continued operation of a TRUQIT..

Service Fees

 

For every Reservation, you understand and agree to be charged a fees as outlined in our Fee Policy.

 

Smartphone Required

 

You understand and agree that all Trucks on the Service are equipped with carshare technology for remote access and that you must arrive at the Truck during the Reservation period and use a compatible smartphone with the TRUQIT app software to unlock the Truck.

​

Cancellations

 

You agree and understand that canceling a Reservation may result in your primary credit card on the Service being charged as outlined in our Fee Policy.

​

Late Returns

 

You agree and understand that returning a vehicle late, after the originally-scheduled end of your Reservation, may result in being charged fees as outlined in our Fee Policy. You further acknowledge that if you do not return a vehicle by the originally-scheduled end of your Reservation, you will be charged for all towing, impound, storage, citation, and recovery costs and fees associated with your failure to return the vehicle as scheduled.

Mileage Limit

 

You agree and understand that every Truck on the Service has a mileage limit of 20 miles per Reservation hour up to a maximum of 200 miles per Reservation day.

​

Service Violations

 

You agree that any violations of this Guest Policy or our Terms of Service from actions taken by you may result in costs charged to your account, at TRUQIT’s sole discretion, to recover all resulting and administrative costs.

​

Hands-Free Usage Prohibited

 

Notwithstanding the presence of any form of assisted driving or autopilot aid, Trucks must be driven with at least one hand holding the steering wheel at all times while in motion, unless such operation is prevented by a physical disability as defined by applicable state or federal law.

​

 

Insurance Claims and Reporting Procedures

 

Insurance Coverage

 

Trips originating in the US are either covered by a policy offered by Bonzah or by the guest’s personal or commercial auto policy. Guests must abide by the terms set forth by the applicable coverage (either Bonzah or the guest’s personal or commercial auto policy).  These policies do not provide a defense or indemnification for any claim asserted by TRUQIT.  Terms and exclusions apply.

If the guest has their own personal auto policy, it will be primary over the auto liability insurance or protection provided with each trip, depending on various factors such as applicable laws, where the guest books the vehicle, and/or where the accident or damages occur.

Filing a Claim

 

If a Truck is damaged during your Reservation, it is your responsibility to gather relevant information and report the damage and related circumstances to TRUQIT within 48 hours of the incident. You understand and agree to report damage to TRUQIT online no later than 48 hours after the end of the incident for TRUQIT insurance coverage to apply, unless you are rendered incapable of doing so. You understand and agree to detail the full nature of the damage and allow time for damage or loss assessment, dispute arbitration, or remediation at TRUQIT’s sole discretion. You understand and agree that failing to report damage within 48 hours of the event occurring may forfeit TRUQIT insurance cover during your Reservation and you will be solely responsible for all repairs and any loss or liability arising from the incident. In addition, failure to report damage within 48 hours of the event occurring will result in an Unreported Damage Fine being charged to your account.

Damage Fee

 

You understand and agree that as part of filing a claim for a loss, your primary payment card on the Service will be charged a Damage Fee outlined in our Fee Policy and that the Damage Fee is charged regardless of whether you are at fault for the loss, unless you have purchased a Protection Plan applicable to the Reservation for which the Damage Fee would otherwise apply. At the conclusion of the claim, a part of or the full Damage Fee may be returned to you should the loss amount not exceed the full Damage Fee or if another party is deemed responsible for the loss.

Negligence, Misuse, or Breach

 

You understand that any negligence, misuse, or breach of this Guest Policy or our Terms of Service may void your TRUQIT insurance coverage and that you will be solely liable for any damage, liability, or loss arising from your actions.

​

Damage Assessment

 

You understand and agree that, in assessing any damage or loss, we will utilize the services of a professional vendor approved by TRUQIT at our sole discretion or an approved vendor selected by the insurance provider representing the liable party.

​

Personal Belongings

 

You understand and agree that personal items left in the car are not covered by TRUQIT’s insurance policy before, during, or after a Reservation.  It is your responsibility to remove personal belongings from the Car when you are not present with it.

​

Indemnification

 

In addition to the general indemnification obligations stated in our Terms of Service, you agree to defend, indemnify, and hold harmless TRUQIT and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your violation of any of the provisions contained within this Guest Policy.

Account Maintenance

 

The “TRUQIT Accounts” section of our Terms of Service specifies the terms pursuant to which you are required to open and maintain an Account with TRUQIT to use the Service. In addition to the requirements listed therein, this section specifies requirements applicable to your Account as part of your use of the Service as a Guest.

At all times while using the Service, Guests shall ensure that their Accounts with TRUQIT remain in good standing. An Account in good standing is one that meets all of the following requirements:

  • The driving record associated with the Account continues to satisfy our Eligibility Requirements.

  • The holder of the Account continues to comply with all laws applicable to the usage of the Service.

  • The holder of the Account continues to comply with the “TRUQIT Accounts” section of our Terms of Service.

  • The holder of the Account continues to operate Trucks in accordance with this Guest Policy.

  • The holder of the Account has not allowed any other individual to operate a Truck reserved by the Account holder, regardless of whether such individual would be considered a Guest under this Policy.

  • The holder of the Account has not operated any Trucks without maintaining a valid default payment method to authorize such operation while such operation is taking place.

  • The holder of the Account does not have any outstanding Claims, charges owed, or balances due to TRUQIT resulting from such Account holder’s usage of the Service.

  • The holder of the Account has not caused damage to Trucks or failed to report such damage to TRUQIT as required by this Guest Policy.

  • The holder of the Account has not received any parking tickets, traffic citations, moving violations, or other offenses related to the operation of TRUQIT vehicles, whether or not such offenses are reported, paid, or settled as necessary.

  • The holder of the Account has not made any misrepresentations, or false or misleading statements, to TRUQIT, and has not otherwise been unresponsive to TRUQIT’s communications during trips, in order to circumvent the requirements of this policy, our Terms of Service, or its supporting policies.

  • The holder of the Account has not interfered with any other TRUQIT member’s usage of the Service or jeopardized the safety or well-being of TRUQIT or any of its customers, employees, contractors, or agents.

  • The holder of the Account has not engaged in speeding while driving a Car during a TRUQIT trip (as determined by TRUQIT in its sole discretion), regardless of the frequency or excessiveness of the speeding, or whether or not such Account holder receives a citation or warning in connection with such speeding.

For clarity, as stated in the “Service Rules” section of our Terms of Service, an Account in good standing may still be permanently terminated or temporarily suspended, without notice or liability, for any reason or no reason. An Account in good standing is a prerequisite to (but not a guarantee of) your access to the Service to participate in the Program.
